Terms and Conditions for the Online Pet Supply Business of PFOTEN&NASEN GmbH
1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts between PFOTEN&NASEN GmbH (hereinafter "Seller") and consumers within the meaning of § 13 BGB (German Civil Code) (hereinafter "Customers") concluded via the online shop of PFOTEN&NASEN GmbH (hereinafter "Shop"). The GTC apply exclusively, unless the Customer has explicitly agreed otherwise in writing.
2. Contracting Party
The Customer's contracting party is PFOTEN&NASEN GmbH, Marienstr. 17, Dorsten, Germany, 46284 , Register Court: Amtsgericht Gelsenkirchen, HRB 18227.
3. Conclusion of Contract
The presentation of goods in the Shop does not constitute a legally binding offer by the Seller, but rather a non-binding online catalog. The Customer can submit a binding offer by clicking the "Buy" button. The Seller will immediately confirm receipt of the Customer's offer via email. Acceptance of the offer by the Seller occurs upon delivery of the goods or through a separate order confirmation.
4. Prices and Shipping Costs
The prices of the goods in the Shop include the statutory value-added tax. Shipping costs are listed separately in the Shop.
5. Payment
The Customer can pay the purchase price by advance payment, bank transfer, PayPal, or cash on delivery.
6. Delivery and Shipping
The goods will be delivered to the delivery address provided by the Customer. The risk of loss of the goods transfers to the Customer as soon as the goods are handed over to the Customer or the Customer is in default of acceptance.
The delivery time is generally 3-5 business days. The period begins with the receipt of the order confirmation by the Customer. In the event of delivery delays, the Seller will inform the Customer immediately.
7. Liability for Defects
The Seller is liable for material defects of the goods in accordance with statutory provisions.
The Customer must inspect the goods immediately upon receipt for defects. Obvious defects must be reported by the Customer to the Seller in writing within 7 days of receipt of the goods.
The Seller reserves the right to repair or replace the defective goods at its discretion.
If subsequent performance fails, the Customer may, at their discretion, reduce the purchase price or withdraw from the contract.
8. Limitation of Liability
The Seller's liability for slightly negligent breaches of duty is excluded.
The Seller's liability for property damage in connection with the delivery of the goods is limited to the foreseeable, contract-typical extent.
The Seller's liability for other damages, in particular consequential damages, indirect damages, and financial losses, is excluded.
The foregoing limitations of liability do not apply to personal injury or damages based on a grossly negligent or intentional breach of duty by the Seller.
9. Data Protection
The Seller processes the Customer's personal data to fulfill the contract.
The Customer can at any time request information about their stored data and request the deletion of their data, provided that there are no statutory retention periods that prevent this.
10. Final Provisions
The contract is governed by German law.
The place of jurisdiction for all disputes arising from or in connection with this contract is the Seller's registered office.
